BANJO’S ViP LOYALTY CLUB

These terms and conditions apply to your access to, and participation in the Banjo’s ViP Loyalty Club membership program (Program) which is operated by Banjo’s Corporation Australia Pty Ltd (Banjo’s). For the avoidance of doubt, these terms and conditions apply to both the Banjo’s ViP Loyalty Club membership card (Banjo’s ViP Card) and the Banjo’s mobile application (Banjo’s mobile app). By providing your details and verifying your email account, mobile number and/or using your Banjo’s membership card and/or by downloading and/or using the Banjo’s mobile app, you agree to these terms and conditions and to any changes or modifications made to them from time to time.

1. BANJO’S ViP CLUB MEMBERSHIP PROGRAM OVERVIEW

Individuals can become Banjo’s ViP Club members (Members) by either collecting a Banjo’s ViP Card from any Banjo’s Bakery Café store, registering their details on the Banjo’s website www.banjos.com.au and then activating their Banjo’s ViP Club or by downloading the Banjo’s mobile app and following the prompts to register and activate the app. Only a verified member can redeem Banjo’s ViP Club Membership Points (Points). To become a verified member, you must verify your email address by clicking on the email sent to you. Once the member has been verified, a Banjo’s ViP Club account (Account) will be created for the Member.

Members who initially become a Member by collecting a Banjo’s ViP Card and then registering and activating the card, will also be able to activate the Banjo’s mobile app and associate their Banjo’s ViP Card during the App sign up process. Members can then use either the virtual card on the Banjo’s mobile app or the physical Banjo’s ViP Card when making purchases and accrue or redeem Points.

Banjo’s ViP Cards are issued by and remains the property of Banjo’s Corporation.

There is a strict limit of one Account per person. Each Account requires an independent email address and mobile phone number that both need to be verified. A Member’s Account may only be used by the verified Member. Multiple individuals cannot share one Member’s Points.

Please read the Privacy Policy carefully to understand how Banjo’s collects, uses and discloses information about its customers and Members.

2. COLLECTION OF POINTS & REDEMPTION

a. Points can be earned in-store at the point of purchase provided that the Banjo’s ViP Card or Banjo’s mobile app barcode associated with a verified Account is scanned at the time of purchase. Alternatively, points will automatically be earned on eligible in-App purchases as long as the Member is signed into the app at the time.

b. Members cannot claim Points from past transactions or receipts.

c. Points are earned as follows: for every $1 you spend at Banjo’s; you will earn 5% back from eligible purchases.

d. Points do not accrue on the following Banjo’s products and already discounted deals:

  • Platters
  • Cold Drinks
  • Newspapers
  • Value Discount Deals e.g. 3 Small Hot Savoury Deal or Mega Family Feast Box Deal

e. Points and rewards under the Program cannot be exchanged for cash and are not transferable or refundable. Points accrued in multiple Accounts cannot be combined.

f. Points cannot be earned in conjunction with any other offer or discount.

g. Members can check their Points balance at any time through their Banjo’s mobile app or by logging into their Account on the Banjo’s website www.banjos.com.au.

h. When redeeming Points in-store at any Banjo’s Bakery Café, Members are required to have sufficient Points to redeem against the full value of a product(s) using Points alone. Members cannot use Points to pay for part of a product, Points must cover the entire cost of the item to redeem. Banjo’s Membership benefits and discounts are available, and Points are redeemed by presenting a valid Banjo’s ViP Card or by scanning the Banjo’s mobile app barcode associated with a verified Account at the time of purchase.

i.  When redeeming Points during in-App ordering, Members are required to have sufficient Points to redeem against the full value of the entire order using points alone. The option to use Points to pay for an in-App order will only be available when sufficient Points exist on the Members account.

3.  ViP BIRTHDAY BONUS

a. From 1 October 2020, eligible Members are entitled to one complimentary Banjo’s Sweet, from the Banjo’s ambient or cake counter. Products included are subject to availability.

b. Eligible Members are members who have signed up to the Banjo’s ViP Club (with or without a physical ViP Card) via the Banjo’s mobile app or via the Banjo’s website and verified their email and mobile number.

c. Eligible Members will be sent an email with a barcode for the complimentary birthday bonus offer. The email will either be sent out 14 days before a member’s date of birth and remains valid until 14 days after the members date of birth. Members who have signed up to the Banjo’s mobile app can also access their Birthday Bonus barcode within the app under the MY OFFERS page.

d. The ViP Birthday Bonus is redeemable in-store only. It is not redeemable when ordering via the Banjo’s mobile app. The offer barcode must be presented and scanned in store to redeem.

d. This offer cannot be redeemed outside of the above period, regardless of circumstances beyond the members’ control, including but not limited to Banjo’s closure, public holidays etc.

e. The complimentary ViP Birthday Bonus is non-transferable and cannot be exchanged or taken as cash. Banjo’s takes no responsibility for incorrect dates being entered during the registration process.

f. If a verified Member joins the Banjo’s ViP Club within the 14 days prior to their birthday, their Birthday Bonus will still be rewarded following verification.

g. The ViP Birthday Bonus offer can only be redeemed once a year during a Member’s birthday month.

h. To be eligible to receive the complimentary ViP Birthday Bonus, the Member must be registered to receive marketing materials from Banjo’s by opting in to receive such marketing communications.

4. LOST, STOLEN, DAMAGED CARDS

a. Banjo’s accepts no responsibility for the loss, theft or destruction of a Member’s Banjo’s ViP Card.

b. If a card is lost, stolen or damaged, Members can collect a replacement ViP Card from any Banjo’s store. Details and Points from the lost/stolen/damaged card can be transferred to the new card. To transfer the Points, Members must login to their Account via the Banjo’s website and update their ViP Membership number and verification code. Alternatively, the Member can contact Banjo’s with their card replacement request. While Banjo’s will make every effort to ensure that the full Points balance is transferred to the new card, Banjo’s will not be responsible for any Points lost prior to the transfer.

5. BANJO’S ViP MEMBERSHIP DETAILS

a. Verified Banjo’s ViP Club Members are responsible for ensuring that their details are correct at all times. It is each Member’s responsibility to ensure that the correct number of Points has been added or deducted for each eligible transaction.

b. Banjo’s reserves the right to communicate with its members, who have opted in to receive marketing material, to inform them of any upcoming marketing activities/promotions and/or offers.

c. Information collected from Members at the time of joining the Program is subject to Banjo’s Privacy Policy. Banjo’s collects personal information from its Members in order to conduct the Program and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and service providers. Banjo’s may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity and research purposes including telephoning the Member or sending messages. 6.  GENERAL

a. Reproduction of a Banjo’s membership card in any form is strictly prohibited. Your Points, benefits, registered Banjo’s ViP Card and your Account are personal to you, and except as expressly permitted under these terms and conditions or the rules of a promotional program, may not be sold, transferred or assigned to, or shared with family, friends or others.

b. Banjo’s reserves the right to terminate your Account/membership and/or your participation in the Program if Banjo’s determines in its sole discretion that you have violated these terms and conditions or that the use of your Account is unauthorised, fraudulent or otherwise unlawful.

c. Banjo’s reserves the right to change or modify these terms and conditions at any time without prior notice. Any changes or modifications will be effective immediately upon posting the revisions and you waive any right you may have to receive specific notice of such changes or modifications.

BANJO’S ONLINE ORDERING

This section of the Terms governs your placement of online orders through the Banjo’s mobile app and the website located at www.banjos.com.au (“Banjo’s online ordering website”) (together, “Online Ordering”).

We provide Online Ordering so that you can place an order online with participating Banjo’s stores located in Australia. Banjo’s stores are independently owned and operated by Banjo’s franchisees.

While we make reasonable efforts to provide accurate and timely information about Online Ordering on the Banjo’s mobile app and the Banjo’s online ordering website, you should not assume that the information provided is always up to date or that the Banjo’s mobile app and the Banjo’s online ordering website contain all the relevant information available.

ACCESS

Access to Online Ordering is via your username and password, which is personal to you. You must therefore not allow your user name and password to be used by anyone else and must not permit or assist anyone who is not a registered user to gain access to any part of the Banjo’s mobile app or the Banjo’s online ordering website. You can change your password at any time within the 'My Profile' page on the Banjo’s app or Banjo’s online ordering website.

PLACING AN ORDER

There are 2 menu options available to order from on the Banjo’s app and Banjo’s online ordering website

  1. Banjo’s Menu (Click & Collect)
  2. Platters

ORDERING FROM THE BANJO’S MENU (CLICK & COLLECT)

  • Orders must be placed on the same day as collection. Orders will only be accepted during store online ordering opening hours.
  • Orders can be placed at least 10 minutes before collection time
  • Menu is based on our full mandatory product range (excluding platters and our bread range except for Sandwich Loaves). Some products are not available to order via the App.
  • Orders ARE automatically accepted and will automatically be processed through your POS at time of collection. The email for a NEW Banjo’s Menu (Click & Collect) order is simply a courtesy message for your store and no confirmation is required.
  • Payment occurs immediately after the customer checks out their order.
  • Eligible items will accrue ViP Points. Normal ViP Club exclusions apply.
  • 5 minutes before an order is due, the order will print out as a receipt for you to prepare.  Applicable products e.g. coffee or toasties will also appear on your bump screens
  • Orders must be prepared as close as possible to collection time (within 5 minutes) to ensure product is fresh, delicious and, where applicable… HOT! 
  • If an order is placed but cannot be fulfilled for any reason, phone the customer as soon as possible (before they arrive at your store) to discuss alternatives.


ORDERING FROM THE PLATTER MENU

  • Platter Menu orders must be placed by 4pm the day BEFORE required.
  • If a customer wishes to place an order for the following day AFTER 4pm, the customer will need to contact their preferred store directly to see if the order can be completed. Payment for these orders must be done over the phone or in-store.
  • Orders are available for delivery from select stores only. A flat rate delivery fee of $10 will be applied to all orders placed for delivery. Delivery is setup on a kilometre (km) radius basis e.g. within 7km in any direction from a store. If there is more than one Banjo’s store that delivers to an area, the store closest to the delivery address will be allocated to the order.
  • Menu includes all our platter varieties, select cold drinks as well as 2L Milks and sliced Sandwich Loaves.
  • Unlike Banjo’s Menu (Click & Collect) orders, platter orders ARE NOT automatically accepted. When you receive a NEW Platter Order email, you MUST click the link provided in the email to confirm the order. Clicking the link will take you to the Banjo’s Online Ordering Portal where you must login to accept the order (see next page for more information).
  • Once you have accepted a NEW Platter Order, the customer will receive confirmation via email and SMS.
  • All Platter Orders MUST be accepted before 4pm each day to allow them to sync to your POS on the day they are due.
  • Payment occurs after the order has been accepted by the store.
  • Platter Orders cannot be paid for using ViP Points and will not accrue ViP Points following purchase.

After you submit your order on the Banjo’s app or the Banjo’s online ordering website, an Order Confirmation summary page will display. It is the customer’s responsibility to ensure the orders details are correct.

PRICE AND PAYMENT

The price you pay will be clearly indicated as you progress through your order and a final total will be displayed at the completion of your order. What you pay online for orders from a specific restaurant may differ from the recommended retail price.

ORDER COLLECTION

You must collect your order from the Banjo’s store nominated by yourself at the time of making the order. You may NOT change your nominated Banjo’s store once an order has been placed and accepted.

DISPUTES AND REFUNDS

If a billing error entitles you to a refund, you agree to accept the refund in the form of a credit on the method of payment used to place your order. Except as required by law, cash refunds will not be provided. If you are dissatisfied with the products or services you received from the selected Banjo’s store, please contact the Banjo’s store that fulfilled your order directly.

TERMINATION

We reserve the right to terminate your ability to order using Online Ordering immediately without notifying you in advance should you not operate your account or make an order in line with section of the Terms.

IP PROTOCOL ADDRESSES AND WEB LOGS

The Banjo’s mobile app and Banjo’s online ordering website servers automatically collect the Internet Protocol (IP) addresses and log files of visitors. Your IP address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit Online Ordering on the Banjo’s app or the Banjo’s online ordering website, along with the time(s) of your visit(s) and the page(s) that you visited. This information is collected in an aggregate form only and does not contain any personal information. We use your IP address, and the IP addresses of all users, for purposes such as calculating Online Ordering usage levels, helping diagnose problems with the Banjo’s app's and Banjo’s online ordering website's servers, and administering Online Ordering. Collecting IP addresses is standard practice on the Internet and is done automatically by many websites. In addition to the non-personal information usage of IP Addresses described above we may also record your IP address for fraud prevention purposes.

CHILDREN & DATA COLLECTION

We will not knowingly allow anyone under 18 to provide them with any personally identifying information. If a child has provided us without the consent of a parent or guardian, the parent or guardian of that child should contact us immediately at info@banjos.com.au. We will use reasonable efforts to promptly delete the child's personal information from our servers.

ACCEPTABLE PERSONAL USE

Your use of the materials included on the Banjo’s app and Banjo’s online ordering website in connection with Online Ordering is for informational, feedback, coupon redemption, and/or ordering purposes only. You agree you will not distribute, publish, transmit, modify, display or create derivative works from, or exploit the contents of, any such materials in any way.

You agree not to use the Banjo’s app or the Banjo’s online ordering website for any purpose that is unlawful or prohibited by these Terms and Conditions, or to cause damage on or through use of the Banjo’s app or the Banjo’s online ordering website.

The materials published on the Banjo’s app and the Banjo’s online ordering website may not be copied or distributed, republished, uploaded, posted or transmitted in any way, except as otherwise permitted by the SIP. All of the materials available on the Banjo’s app and the Banjo’s online ordering website are proprietary and protected by copyright or other rights and nothing herein shall be construed as conferring in any manner, whether by implication, estoppel or otherwise, any title or ownership of, or exclusive use-rights to, any intellectual property or other right and any goodwill associated therewith.

We may or may not control those sites or their privacy practices, which may differ from our privacy practices. We do not endorse or make any representations about third party websites. The personal data you choose to give to unrelated third parties is not covered by our privacy policy and you are encouraged to review the privacy policy of any company or website before submitting your personal information. Some third parties may choose to share their personal data with us and; that sharing is governed by that third party company’s privacy policy.
